Retainer Terms & Conditions:

1. Subscription-Based Services

Lekker Digital operates on a flexible monthly subscription model. Clients may pause their subscription at any time, provided notice is given before the billing cycle, which commences on the 25th of each month. During the pause period, your website will be taken offline and all active digital marketing services (including social media content, newsletters, etc.) will be temporarily suspended until payment resumes.

2. Reactivation

Subscriptions may be reactivated at any time. Services will resume with no additional setup fees, provided reactivation occurs within three (3) months of the initial pause. Should the pause extend beyond three months, a once-off reactivation and administration fee of N$2,000 will apply.

3. Website Setup Fee

A once-off setup fee is required for all website projects. This covers the full design and development of your website. A fixed monthly fee will be applicable thereafter, covering hosting, maintenance, and ongoing support. Clients may opt to host the website independently; however, this will not affect the monthly service fee, which remains unchanged.

4. Monthly Retainer Inclusions

Each retainer includes a predefined scope of services, which may consist of website hosting and maintenance, social media content creation, management, newsletters, or other marketing deliverables as agreed upon in writing. Any work beyond this agreed scope will be quoted and billed separately.

5. Payment Terms

Invoices are issued on the 25th of each month. Full payment is required upfront, prior to the commencement of the following month’s work. Delayed payments will result in a suspension of services until all outstanding amounts have been settled. Repeated late payments may result in the termination of services.

6. Cancellation Policy

Subscriptions may be cancelled at any time without penalty. Upon cancellation, all active services will be paused and relevant content archived. Should the client choose to resume services at a later stage, work will recommence from where it left off, subject to availability and any applicable fees.

7. Ownership & Access

Clients retain full ownership of all content and branding assets created by Lekker Digital as part of their retainer, including social media graphics, newsletters, and written content, provided these have been fully paid for. Upon cancellation, clients may request access to these deliverables, and Lekker Digital will provide all relevant files, excluding open files.

Please note: all websites designed, developed, and hosted by Lekker Digital remain the intellectual property of Lekker Digital. If a client cancels their subscription, the website will be taken offline and will not be transferred or handed over.

Clients may request to purchase full ownership of their website upon cancellation of their retainer. The buyout cost will vary depending on the duration of the active subscription period. For example, a client who has hosted their site with Lekker Digital for 3 years will pay significantly less than one who has only been on the retainer for 3 months.

8. Annual Price Adjustment

To ensure we can continue providing high-quality service despite rising operational costs, our pricing is subject to an annual inflation adjustment. As of 1 January each year, all rates will increase by 7%. Clients will be notified of the new rates in advance, and the adjustment will apply from the first invoice of the new calendar year.

9. Communication & Turnaround Times

To keep projects moving smoothly, all client content approvals, feedback, and communication should be submitted via email within a reasonable time. Standard turnaround time for most design or content deliverables is 3–6 working days, unless otherwise agreed. For website development projects, the standard turnaround time is 3–6 weeks, depending on the scope. Delays in providing required input or approvals may impact delivery schedules.

10. Limitation of Liability

Lekker Digital will take all reasonable measures to deliver high-quality services. However, we are not liable for any indirect or consequential losses (e.g., loss of income, leads, or business opportunities) resulting from service delays, errors, or website downtime.
